Terms and Conditions, Términos y Condiciones (Espanol, lea abajo )

By hiring Claudia Hernandez the "Photographer", you the Client agree to the following terms and conditions:

Booking and Payment

A non-refundable retainer fee of 50% of the total quoted price is due at the time of booking to secure services for your event date. The remaining 50% balance is due on or before the event date. Accepted payment methods are cash, check, credit/debit card, or bank transfer.

Rescheduling/Cancellation

Any cancellations must be made at least 30 days prior to the event date to receive a full refund minus the non-refundable retainer fee. Rescheduling is permitted with at least 14 days notice before the original event date at no extra cost.
The client understands and agrees that the new requested date may or may not be available, and the client will have to accept an available date indicated by the photographer.

Digital Files & Prints

Digital image files and printed products remain the property of the Photographer until full payment is received. The Photographer retains copyright over all images. Client is granted personal reproduction rights for their own use. The Photographer is not responsible for preserving images/data once delivered to the Client. Backup/storage is the Client's responsibility.

Communications & Marketing

By providing contact information, the Client consents to receiving communications from the Photographer via email, SMS, phone etc. regarding their photography services, including automated messages. The Photographer reserves the right to use images from the Client's event for marketing/promotional purposes.

Liability & Images

In the unlikely event of lost/damaged images due to camera/equipment malfunction, liability is limited to a refund of fees paid. The Photographer will make best efforts to deliver all contractually agreed upon images. The Photographer is not responsible for poor imagery due to factors outside their control (e.g. weather, location restrictions, fire, equipment damage, etc.).

Other Terms

Travel fees may apply for events outside of Columbus, Seymour, Edinburgh. Additional fees apply for extensive editing requests beyond typical retouching. The Photographer cannot guarantee specific shots/backgrounds, but will make best efforts to accommodate reasonable requests.

Image Use and Promotion

The Client agrees to allow the Photographer to use selected images from their event/session on the Photographer's website, blog, social media pages (e.g. Facebook, Instagram), online portfolios, and other marketing materials for promoting their photography business. The Photographer shall have perpetual and non-exclusive rights to display, reproduce, and distribute the images worldwide for promotional and advertising purposes only. The Client's name and other personal details will not be disclosed publicly without prior consent. The Client acknowledges that while the Photographer will use their best efforts to notify or credit the Client when sharing their images online, there is no guaranteed obligation for notification on every instance of use. The Client releases the Photographer from any claims or liability resulting from the use of these images for marketing purposes as outlined above.

By booking services, the Client agrees to be bound by these Terms and Conditions. The Photographer reserves the right to update these terms at any time with reasonable notice.

Términos y Condiciones

Al contratar a Claudia Hernández, la "Fotógrafa", usted, el Cliente, acepta los siguientes términos y condiciones:

Reserva y Pago

Se requiere un depósito no reembolsable del 50% del precio total cotizado al momento de hacer la reserva para asegurar los servicios para la fecha de su evento. El saldo restante del 50% debe pagarse en o antes de la fecha del evento. Se aceptan métodos de pago en efectivo, cheque, tarjeta de crédito/débito o transferencia bancaria.

Reprogramación/Cancelación

Cualquier cancelación debe realizarse al menos 30 días antes de la fecha del evento para recibir un reembolso total menos el depósito no reembolsable.Se permite la reprogramación de la fecha con un aviso de al menos 14 días antes de la fecha original del evento sin costo adicional.

El cliente entiende y esta de acuerdo que la nueva fecha requerida puede o no puede estar disponible y que el cliente tendra que aceptar una fecha disponible indicada por la fotografa.

Archivos Digitales e Impresiones

Los archivos de imágenes digitales y los productos impresos siguen siendo propiedad de la Fotógrafa hasta que se reciba el pago completo. La Fotógrafa conserva los derechos de autor sobre todas las imágenes. Al Cliente se le otorgan derechos de reproducción personal para su propio uso. La Fotógrafa no es responsable de preservar las imágenes/datos una vez entregados al Cliente. La copia de respaldo/almacenamiento es responsabilidad del Cliente.

Comunicaciones y Mercadeo

Al proporcionar información de contacto, el Cliente consiente en recibir comunicaciones de la Fotógrafa por correo electrónico, SMS, teléfono, etc. con respecto a sus servicios de fotografía, incluyendo mensajes automatizados. La Fotógrafa se reserva el derecho de usar imágenes del evento del Cliente para fines de mercadeo y promoción.

Responsabilidad e Imágenes

En el improbable caso de que se pierdan o dañen imágenes debido a un mal funcionamiento de la cámara/equipo, la responsabilidad se limita a un reembolso de las tarifas pagadas. La Fotógrafa hará los mayores esfuerzos para entregar todas las imágenes acordadas contractualmente.La Fotógrafa no es responsable de imágenes deficientes debido a factores fuera de su control (p. ej., clima, restricciones de ubicación, incendios, dano de equipo, etc.).

Otros Términos

Se pueden aplicar tarifas de viaje para eventos fuera de Columbus, Seymour, Edinburgh. Se aplicarán tarifas adicionales por solicitudes de edición extensas más allá del retoque típico. La Fotógrafa no puede garantizar tomas/fondos específicos, pero hará los mayores esfuerzos para acomodar solicitudes razonables.

Uso y Promoción de Imágenes

El Cliente acepta permitir que la Fotógrafa use imágenes seleccionadas de su evento/sesión en el sitio web, blog, páginas de redes sociales (p. ej., Facebook, Instagram), portafolios en línea y otros materiales de mercadeo de la Fotógrafa para promover su negocio de fotografía.La Fotógrafa tendrá derechos perpetuos y no exclusivos para mostrar, reproducir y distribuir las imágenes a nivel mundial solo para fines promocionales y publicitarios.El nombre del Cliente y otros detalles personales no se divulgarán públicamente sin consentimiento previo. El Cliente reconoce que si bien la Fotógrafa hará sus mejores esfuerzos para notificar o acreditar al Cliente cuando comparta sus imágenes en línea, no hay obligación garantizada de notificación en cada instancia de uso. El Cliente libera a la Fotógrafa de cualquier reclamo o responsabilidad resultante del uso de estas imágenes con fines de mercadeo según lo descrito anteriormente.

Al reservar los servicios, el Cliente acepta estar sujeto a estos Términos y Condiciones. La Fotógrafa se reserva el derecho de actualizar estos términos en cualquier momento con un aviso razonable.
